Terms and Conditions (AGB)

§ 1 Provider and scope

These Terms and Conditions apply to the Packbay iPhone and web apps, their free core features and the paid Premium subscription. The provider is:

The contract language is German. The translations are provided as a reading aid; the German version forms the contractual basis. Apple's terms apply additionally to purchases made through the Apple App Store.

§ 2 Service and requirements

Packbay is a digital service for collaborative travel planning within a household. The free features include trip and day planning, checklists, budget management and household invitations. Packbay Premium covers one household and additionally includes a travel mailbox as a read-only feed and AI-assisted country reports.

AI reports are automatically generated planning aids and do not replace information from competent authorities. You must verify safety, health and entry information with the competent authorities.

An internet connection, a current supported browser or an iPhone compatible with the minimum version stated in the App Store is required. The web app and iPhone app access household data through the same access-protected Packbay account.

§ 3 Contract conclusion and account

To create a free account, you enter the registration details, can review and change them before submitting, confirm the minimum age and these Terms and select “Create account”. We then create the account; you can use it after confirming your email address. For Premium, you select the offer and review the order details in the Apple App Store or, if a web subscription is offered, in Stripe Checkout. Until the final purchase confirmation, you can correct entries using the controls provided there or cancel the process. The Premium contract is concluded when the order is confirmed through the respective ordering channel.

You can retrieve and save these Terms before concluding the contract. For a free account, the email-verification message also contains a contract confirmation and the terms applicable when the contract was concluded on a durable medium. No individual contract text is available for retrieval in the account itself. We also send a contract confirmation for a web subscription by email. Apple provides its purchase confirmation for App Store purchases. No special codes of conduct apply.

• You must be at least 18 years old to have your own account.
• Your information must be accurate and kept up to date.
• The account is not transferable. Protect your access credentials and report any suspected misuse to support@packbay.app.

§ 4 Premium, price, term and cancellation

Packbay Premium has a term of one month and renews for a further month at a time unless it is cancelled. The total price and payment method are displayed immediately before the order. You can cancel at any time with effect from the end of the current billing period; Premium remains available until then.

Apple manages billing and renewal of iPhone subscriptions through the Apple account. A subscription concluded through the web app is billed through Stripe and can be managed in the Stripe customer portal. The public “Cancel contracts here” function is also available. Statutory rights to make declarations and other consumer rights remain unaffected.

§ 5 Right of withdrawal for consumers

A statutory 14-day right of withdrawal generally applies to a Packbay account and a Premium subscription. We make the features available immediately and do not charge compensation for their use during the withdrawal period.

For a purchase through Apple, you can additionally use the refund channels offered by Apple. Your statutory rights and your ability to declare withdrawal to us remain unaffected.

§ 6 Use, defects, updates and changes

You must not use the service unlawfully, infringe third-party rights, circumvent security measures, attack the systems or subject them to abusive automated load. The travel mailbox is intended for travel documents; you must not intentionally use it for unlawful content, spam or bulk mailing.

In shared trips, checklists, itineraries and other household areas, threats, harassment or bullying, hate or discrimination, sexualised or exploitative content, glorification of violence and any other clearly objectionable or rights-infringing content or conduct are prohibited. Users can report affected content or members in the app. We may review a report, remove prohibited content and suspend a member's access in the event of serious or repeated violations, taking due account of the nature, context and severity of the violation.

The statutory rights in respect of defects in digital products apply. During the contract term, we provide the updates, including security updates, required to maintain conformity with the contract and inform you about them. Maintenance and disruptions for which we are not responsible may temporarily restrict the service; statutory rights in the event of failure to provide the service or defective performance remain unaffected.

Changes beyond necessary bug fixes, security updates or maintaining conformity with the contract are made only for a valid reason, in particular because of new technical environments, binding platform or security requirements or changes in the law, and without additional cost. If a change impairs access or use to more than a minor extent, we will inform you in advance on a durable medium about its features, timing and your statutory rights. Section 327r of the German Civil Code (BGB) remains unaffected.

§ 7 Liability and termination

We are liable without limitation in cases of intent and gross negligence, for injury to life, limb or health, under the German Product Liability Act and where mandatory law provides for liability. In cases of ordinary negligence, we are liable for breach of a material contractual obligation; liability is then limited to the foreseeable damage typical for the contract.

The free account continues for an indefinite term and can be deleted at any time in the app or web app. Deleting the account does not terminate an Apple subscription; it must also be cancelled with Apple. You can terminate a web subscription in the Stripe customer portal or through the public cancellation function. We may terminate the contract or suspend the account for good cause, in particular in the event of serious or repeated breaches. Where reasonable, we will notify you of the breach in advance. Statutory rights remain unaffected.

§ 8 Changes to the Terms and final provisions

Changes to these contractual terms take effect only with your express consent. Changes to the digital service permitted by law are governed by § 6.

German law applies. If you are a consumer, the mandatory protective provisions of the country in which you habitually reside remain unaffected.
